Terms of Service
Effective October 12, 2026
1. Who we are and what these terms cover
Atelier (“the app”) is made by Cruxbit Labs LLC, a Florida limited liability company (“Cruxbit Labs”, “we”, “us”). These Terms of Service are an agreement between you and us. They cover the app, your account, your subscription and the pages on cruxbitlabs.com about Atelier. Our Privacy Policy, Acceptable Use Policy, Cancellation and refunds page and the End User Licence Agreement you accept when you install Atelier are part of these terms.
You accept these terms when you tick the box while creating your account, when you accept them in the app or its installer, or when you agree to them at checkout. If you don't agree, don't use Atelier.
2. Who can use Atelier
You must be at least 18 years old and able to enter a binding contract. If you use Atelier for a company or other organisation, you confirm that you can accept these terms for it, and “you” includes that organisation.
3. Your account
- Give us a real email address that you can receive mail at, and keep your password safe.
- Your account is for one person. Don't share it or sell it.
- You're responsible for what happens under your account. Tell us at once if you think someone else has used it.
- Your Atelier sign-in may also work with other Cruxbit Labs products. Each product has its own terms.
4. Subscription, renewal and payment
- Paid only. Atelier needs an active subscription. The price, currency, billing period and any taxes are shown on the secure Stripe payment page before you pay.
- Automatic renewal. Your subscription renews automatically at the end of each billing period, and we charge your payment method the price then in effect, until you cancel.
- Cancel any time. Cancel in the app under Settings, Account, Manage billing, or by emailing us. Cancelling stops future renewals; you keep access until the end of the period you've already paid for. See Cancellation and refunds.
- Promo codes. A promo code may give you a discount or a free period. A payment method is always required. When the promo ends, your subscription continues at the regular price unless you cancel first. Promo codes have their own limits and expiry dates and can't be exchanged for cash.
- Failed payments. If a payment fails, Atelier locks until the open invoice is paid. Your work stays on your computer. If the invoice stays unpaid, the subscription may be cancelled.
- Price changes. We'll email you at least 30 days before a price change applies to your subscription. If you don't want to pay the new price, cancel before it takes effect.
- Payments are handled by Stripe. We never see or store your full card number. Stripe's own terms apply to the payment itself.
5. How the subscription is checked
Atelier checks your subscription with our servers when it starts and from time to time while it runs. To keep working offline, it must be able to check in at least once every 5 days. Your subscription runs on one computer at a time, and up to 2 computers can be registered to it; you can switch between them, and remove a computer from the list in the app (how often is limited). If your subscription stops being active, the app locks until it's active again. Don't try to get around these checks.
6. Your licence to use Atelier
While your subscription is active and you follow these terms, we give you a personal, non-exclusive, non-transferable, revocable licence to install and use Atelier on computers you own or control, within the computer limit above. Atelier is licensed, not sold. We and our licensors keep all rights not expressly given to you.
You may not, and may not help anyone else to:
- copy, sell, rent, lend, sublicense or redistribute the app, or any part of it;
- reverse engineer, decompile or disassemble it, except where the law allows this despite this restriction;
- remove or bypass the sign-in, subscription or computer checks, the licence checks that decide which AI models Atelier offers you, or any notices in the app;
- use the app to build a competing product, or offer it to others as a hosted service;
- use it in breach of the Acceptable Use Policy or the law.
7. AI models and other third-party software
Atelier runs AI models and other open-source software on your computer. During setup it downloads them from their publishers: models such as Z-Image Turbo, FLUX.2 [klein] 4B, Qwen-Image-2512, HiDream-O1, Wan 2.2, SeedVR2, Pixal3D, TRELLIS.2, and Meta's SAM 3.1 and DINOv3, and tools such as ComfyUI, Blender and FFmpeg. Each comes with its own licence, and some come with their own use policies; we list them on our open source and AI models page and in the third-party notices that come with Atelier. By using a model you agree to follow its licence and policy. In particular, Meta's SAM and DINOv3 licences don't allow use subject to the US International Traffic in Arms Regulations or prohibited by trade controls, including military, warfare, nuclear, espionage or weapons purposes (see our Acceptable Use Policy).
Atelier only offers models whose licences, as we understand them, allow commercial use, but you are responsible for how you use them and what you make with them. If a model's licence changes or its publisher withdraws it, we may change or remove it (section 10). Krea 2 comes under Krea's own licence, which you accept in the app before Atelier uses it, which allows business use only while your organisation's yearly revenue (counting companies under the same ownership) is under US$1,000,000, unless you have an Enterprise licence from Krea, and which requires the content filter Atelier applies to every Krea 2 prompt and picture. So that the software installs without a prompt for each program, Atelier's setup accepts the programs' package licence agreements for you, after you agree on its Setup screen.
8. Optional services you connect yourself
Some features let you connect your own account with another company, such as a Google Gemini API key or a Claude account from Anthropic. When you use them, what you send goes directly to that company, under its terms and privacy policy, and it bills you, not us. We don't resell, pay for or relay those services, and we're not responsible for them. Google requires Gemini API users to be 18 or older and, in the European Economic Area, the United Kingdom and Switzerland, to use a paid (billed) API key in apps like Atelier; images from Google's models carry Google's SynthID watermark. Claude Code is installed with Anthropic's own installer and you sign in through Anthropic; Atelier never sees your Claude credentials.
9. What you make
Between you and us, you own the images, video, 3D models and other output you make with Atelier, and the prompts and files you put in, as far as the law allows. We don't claim any rights in them, and because Atelier runs on your computer, we don't receive them. Whether output can be protected by copyright, and whether it infringes someone else's rights, depends on the law where you are and on what you make. You are responsible for your inputs and outputs and for how you use them. AI output can be wrong, unexpected or similar to other people's work; check it before you rely on it or publish it.
10. Updates and changes to Atelier
We may update Atelier, change or remove features, or change which models it offers, for example because a licence changes. Some updates may be required to keep using the app. If a change takes away a major feature you rely on, you can cancel, as described in Cancellation and refunds.
11. Ending this agreement
You can stop using Atelier and cancel at any time, and you can ask us to delete your account. We may suspend or end your access if you seriously or repeatedly break these terms, if we must by law, or if we stop offering Atelier. If we stop offering Atelier for reasons other than your breach, we'll refund the unused part of your current billing period. When this agreement ends, your licence ends and you must stop using the app. Sections 7, 9 and 12 to 16 continue after it ends.
12. Disclaimer
To the fullest extent the law allows, Atelier is provided “as is” and “as available”. We don't promise that it will be error-free or uninterrupted, that it will run on every computer or graphics card, or that any output will be accurate, original or fit for a particular purpose. We disclaim all implied warranties, including merchantability, fitness for a particular purpose and non-infringement. Back up your work: it lives on your computer and we can't recover it.
13. Limit of liability
To the fullest extent the law allows, we are not liable for indirect, incidental, special, consequential or punitive damages, or for lost profits, revenue, data or goodwill, arising from or related to Atelier or these terms. Our total liability for all claims related to Atelier or these terms is limited to the amount you paid us for Atelier in the 12 months before the claim arose. Some places don't allow these limits, so they may not all apply to you.
14. Your responsibility to us
If someone makes a claim against us because of what you made or did with Atelier, or because you broke these terms or the law, you agree to cover our reasonable losses and costs from that claim, to the extent the law allows.
15. Law and disputes
These terms are governed by the laws of the State of Florida and the United States, without regard to conflict-of-law rules. Before starting a formal dispute, please email us so we can try to sort it out. Any dispute that we can't resolve will be heard in the state or federal courts located in Florida, and you and we consent to their jurisdiction. If you're a consumer, this doesn't take away any protection the law of the place you live gives you.
16. General
- You may not transfer these terms or your account to anyone else. We may transfer them as part of a merger, acquisition or sale of the business.
- If part of these terms can't be enforced, the rest still applies.
- If we don't enforce a term straight away, we haven't given up the right to enforce it later.
- These terms are the whole agreement between you and us about Atelier.
- You agree to follow US export control and sanctions laws. Atelier isn't sold in, and may not be used in or for anyone in, Cuba, Iran, North Korea, Syria, Russia, Belarus, or the regions of Ukraine under occupation, or by anyone on a US government restricted-party list. A subscription paid from one of these countries is cancelled and refunded.
- Product names such as FLUX, ComfyUI, Blender, Gemini, Claude, Qwen and Meta are used only to say what Atelier works with. They belong to their owners, who don't endorse Atelier.
17. Changes to these terms
We may update these terms. The date at the top shows the current version. When we make a material change, we'll tell you by email or in the app, and Atelier will ask you to accept the new version before you continue. If you don't accept it, you can cancel.
